Service Terms & Conditions

Effective upon becoming a client of Dusty Roads Media

Overview

These Terms & Conditions outline the working relationship between Dusty Roads Media (DRM) and its clients. By engaging DRM for any project or service, the client agrees to the terms described on this page.

1. Services Provided

Dusty Roads Media provides professional creative and technical services, including:
Items:
  • Website design & development
  • Website hosting (resold from HostGator)
  • Domain name registration & management (through Moniker, under DRM ownership)
  • Website maintenance & updates
  • SEO copywriting & content strategy
  • Content creation (graphics, images, page layouts, and written content)

Additional services may be offered as needed.

2. Third-Party Tools, Licensing & Pass-Through Costs

Some projects require paid third-party tools such as premium WordPress themes, plugins, and integrations.

Items:
  • All licensing and subscription fees are passed directly to the client.
  • The client owns and controls their licenses.
  • DRM installs and configures these tools but does not own or resell them.

3. Domain Name Registration

Domains purchased through DRM are registered under Dusty Roads Media for:
Items:
  • Client privacy and data protection
  • Security
  • Preventing accidental expiration
  • Automatic renewals
  • Unified management for hosted clients

Clients may take full ownership of a domain name at any time by paying:

Items:
  • The fair market value of the domain, or
  • A negotiated transfer fee

Once transfer terms are satisfied, DRM will unlock the domain and provide the authorization/EPP code.

4. Payment Terms

Hosting Plans

One-Time Services

Hosting is billed annually, with the option for monthly or annual payments. Service begins only after the initial payment.

Payment in full is required upfront for:
  • Website design
  • SEO copywriting
  • Content creation
  • Custom development work

No work begins until payment is received.

5. Exclusive Access Policy

Items:
  • No other developers, designers, or agencies may access or modify websites that are hosted or maintained by DRM.
  • This includes editing code, installing plugins, altering themes, modifying DNS settings, or working within DRM-managed accounts.
  • This policy protects site stability and the integrity of hosted environments.

6. Revisions

This Terms & Conditions page represents the 15th revision of DRM’s policies.

Unless otherwise specified in a proposal:
  • Revisions apply only to the original project scope.
  • Significant content changes or feature requests may incur additional fees.

7. Project Timeline & Client Responsibilities

A project timeline will be provided at the start of each engagement.

To maintain deadlines:
  • Clients must supply required content (text, images, logins, approvals) promptly.
  • If a client does not provide needed materials within 7 days, the project pauses automatically.
  • When materials are delivered, the project is rescheduled based on DRM’s current availability.
DRM is not responsible for delays caused by late client materials.

8. Refund Policy

Because time and resources are immediately allocated:
  • No refunds are given after work has begun.
  • Hosting and domain registration fees are non-refundable.

9. Ownership of Work

Upon final payment:
  • Clients own the website content, SEO copywriting, and custom graphics created for them.
  • DRM retains ownership of proprietary processes, development structures, and internal configurations used to build or maintain websites.
Domain ownership is covered in Section 4.

10. Maintenance & Support

Clients with active hosting or maintenance plans receive:
  • Routine updates
  • Security scanning
  • Plugin & theme updates
  • Basic troubleshooting

Additional content updates or advanced maintenance may require an upgraded support plan or hourly services.

11. Termination of Services

Either party may end the working relationship at any time. Upon termination:
  • All outstanding invoices must be paid prior to file or domain transfers.
  • Hosting access ends immediately when service is canceled.
  • Domain transfers must follow the policies described above.

12. Liability

DRM is not responsible for:
  • Service outages from third-party providers (HostGator, Moniker, plugin developers)
  • Issues caused by unauthorized edits or client-installed tools
  • SEO performance or search engine ranking outcomes
  • Delays caused by incomplete client materials
DRM provides reasonable care and industry-standard practices in all work performed.

13. Agreement

By becoming a client of Dusty Roads Media, the client acknowledges and accepts these Terms & Conditions. No signature is required.
